The below privacy notice (“Privacy Notice”) is provided by KitchenAid Europa Inc., a corporation under the law of the state of Delaware, USA, trading through its subsidiary with headquarters registered at Nijverheidslaan 3 - box 5 1853 Strombeek Bever, Belgium, a part of the Whirlpool Group in its capacity as a data controller ("KitchenAid", "we" or "us"), and applies to users of this website (“Website”) and/or the Apps and any other individuals who interact with us through other channels ("Users", "you" or "your").

The Privacy Notice provides the main information regarding the methods used to collect and process Users' personal data, in accordance with the provisions of the General Data Protection Regulation (Regulation (EU) No. 2016/679) and/or any other applicable local laws and regulations (including the UK GDPR) ("GDPR").

For any clarifications or requests regarding the Privacy Notice and the data processing carried out by KitchenAid, you may:

INFORMATION WE COLLECT

We collect personal data that you have shared with us, data we collected when we conclude sales and services transactions with you, data collected by our call centers, data concerning your activity on the Website or the App and information provided or collected through other sources.

We do not collect special categories of personal data relating to you (e.g., health or judicial data).

We use your personal data to provide you with the services requested, including but not limited to, getting in touch with you in case of security issues related to your household appliance, allowing you to surf the Website and/or to use the App, responding to requests and to interact with our services including the ones offered through call centers.

We may also process your personal data to send you marketing communications, including offers and discounts from us and our trusted partners. With a specific consent, we may also profile your preferences and interests in order to send you personalized marketing communications.

We may record the phone calls made by you to our call center. Depending on the country you are calling from, the holding message will ask you for consent or inform you that your call is being recorded to pursue our legitimate interest.

1. TYPE OF PERSONAL DATA PROCESSED

KitchenAid processes the following categories of personal data, depending on the type of interaction with you:

 

1. Data provided by you directly

KitchenAid processes personal data concerning you collected or provided directly by you through different channels and on different occasions, as well as from different sources. Examples of personal data we collect include:

  1. personal data provided at the time of creating an account on the Website and/or on the App, of purchasing a KitchenAid product or service through the Website, of registering the product purchased, sending a request for information, assistance or services related to the purchase (such as, name, surname, residential address, e-mail, birthdate, telephone number, appliances purchased by you, services requested by you); 
  2. personal data provided during phone calls to our call centers (including call dates and times, caller contact information and information relating to your order); 
  3. personal data you have provided to us or third parties when registering for marketing communications (in electronic or non-electronic form, e.g. newsletters) or promotions, prize draws or competitions;
  4. personal data contained in images, audio and/or video you submit or allow the App to capture;
  5. personal data provided by other parties’ products or services that you connect through the App. 

In addition, KitchenAid collects data about the appliances you purchase and/or the services you order, including requests for warranty services.

We may receive your personal data from third parties, such as insurance and distribution companies. 

 

2. Data collected through the Website and Apps

The Website and Apps collect your personal data for various reasons (including technical and related to their functioning), such as: (i) the IP address and domain name of your computer; (ii) the type of browser and operating system used; (v) the physical location of your device (as determined, for example, using satellites, mobile phone towers and WiFi signals); and (iii) other information about your online session, such as the Uniform Resource Identifier (URI) addresses of the requested resources, the time of the request, the method used to send the request to the server, the size of the file received in response, the numerical code related to the status of the response received from the server and other parameters relating to the operating system used by the User's device. We may track and collect App usage data, such as the date and time the App accesses our servers or what information has been downloaded to the App.

The data collected through the Website and the App are also used for the purpose of collecting anonymous statistical information on the use of the Website, the App and to check their correct functioning, and are stored according to our information retention requirements. However, for some activities, such as after-sales services or control and/or performance measurement activities, personal data may be processed.

This data may also be used to ascertain liability in the event of computer crimes perpetrated against the Website and/or the App.

On our Website, we may collect both information that does not constitute personal data (for example, to check the Website is properly functioning and to produce anonymous statistics on the use of the same), and information that contains personal data of the User, through different types of cookies or other tracking technologies (for example, pixels and web beacons), after you have given your consent to the installation of such technologies (where consent is required). Further information on the cookies we install through the Website can be found in our Cookie Notice. If the information collected through cookies is personal data, in addition to the aforementioned cookie notice, this Privacy Notice will also apply: please refer to the relevant sections.

 

2. PURPOSES, LEGAL BASIS OF THE PROCESSING AND STORAGE OF DATA

Where applicable, we will process your personal data that we have collected or that has been provided to us for the following purposes:

The provision of personal data is necessary for this purpose. If you do not provide your personal data, it will not be possible to have you register the purchased product.

For the duration of warranty and in accordance with applicable law.

c) Complete the purchase of a product on the Website and provide you with related services under the contract, including customer service, after-sales services (such as home delivery, installation, removal, procurement of spare parts, repair, replacement, etc.).

The provision of personal data is necessary for this purpose. If you do not provide your personal data, it will not be possible for you to purchase the product or access the related service requested.

 

For the duration of the contract and beyond as permitted by in accordance with applicable law.

d) Process and manage information requests related to our products and services which you send through the channels made available by KitchenAid, including our interactive chat service.

The provision of personal data is necessary for this purpose. If you do not provide your personal data, it will not be possible for us to respond to your request.

For the time necessary to fulfill the request. 

e) Send you marketing communications (in electronic form) regarding our products and services, also bought or registered (by e-mail, SMS, push notifications and banner on Meta social media platforms and Google platforms); when we are marketing through these platforms, we may also exclude you (or from receiving our marketing communications). We may also carry out market research.

  • Your freely given consent - Art. 6(1)(a) GDPR. The provision of personal data is optional for this purpose. If you do not provide consent, there will be no consequences of any kind for you. If you have given your consent, you may revoke it at any time also through the button available at the bottom of each marketing communication you will receive.
  • If you provide consent on our German channels, we use the “double opt-in” procedure for marketing. This means that we will send you a request to confirm your intention to receive marketing after you have consented to receive marketing. 
  • If marketing communications are sent to your email address, which you provided to us in the context of purchasing a product or a service from KitchenAid, and such communications relate to products similar to those purchased by you, the legal basis is the legitimate interest of KitchenAid - Art. 6(1)(f) GDPR and Article 13(2) of Directive 2002/58/EC. The provision of personal data is necessary for this purpose, which is our legitimate interest to continue to provide you with offers of similar products and services. You may at any time object to the processing carried out for this purpose, including through the button available at the bottom of each marketing communication you will receive.

In case of legitimate interest, until you object to the processing of your data for this purpose.

In case of consent, until you withdraw your consent (unless this expires earlier in compliance with local regulatory guidance). 



f) collect and analyze your history and interests as our consumer (including purchases made, products registered, repair history, complaints, review scores, enrollment in loyalty program, interactions with our advertisements, including those sent by email, interests, demographic data, preferences shown in our preference center) and/or rely upon Meta’s or Google's monitoring of your characteristics, behaviors and interests shown on Meta or Google social media platforms (e.g. page visitors, age, gender, main city, interests, intent to buy) and to create targeting audiences in our internal platform and on Meta Ireland Limited's and Google's social media platforms and, in order to send or show you (or exclude from showing you) personalized marketing communications. To do so, we may also combine personal data we collected with personal data collected through tracking technologies (if you have provided your ad hoc consent – please see below for more information).

Your freely given consent - Art. 6(1)(a) GDPR. The provision of personal data is optional for this purpose. If you do not provide consent, there will be no consequences of any kind for you. If you have given your consent, you may revoke it at any time also through the preference center which you can access through the button at the bottom of each marketing communication.

Data used for this purpose is kept for the time necessary to fulfill the purposes. 

g) Carry out analytics across systems where we host your personal data in order to enrich, improve or gain further insight into such data and datasets. This purpose includes activities such as the development and improvement of our applications, products and/or services and their analysis to help us better understand our customers in order to offer the most relevant communications, services, and experiences to them. Also, we may combine these data with data collected through tracking technologies.


The personal data we use for this purpose include:


  • Products you purchased or registered (time of purchase or registration, product model, purchase price, location of purchase or registration (e.g. whether from a retailer or an ecommerce platform)
  • Warranties or spare parts you purchased
  • History of repair in relation to your products or spare parts
  • Any complaints in relation to your products or spare parts
  • Scores of reviews you have provided 
  • enrollment in loyalty program, 
  • Interactions with our communications 
  • Delivery and installations you have received from us.

The legitimate interest of KitchenAid or a third party - Art. 6(1)(f) GDPR, to optimize and improve our products, and continue to market them in an efficient manner.






Until the purpose for which the personal data is originally collected no longer exists and such data is deleted in accordance with the retention periods set out in this section 2. 

h) Send you customer satisfaction questionnaires via email or sms and evaluate your degree of satisfaction with the product purchased or the services you have used, in order to improve the products and services offered to you (including by KitchenAid suppliers). 

The questionnaires will be anonymous, except for the questionnaires relating to the delivery and installation service or feedback on your customer service experience, in which you will be asked for certain data (such as you contact information to be called back from our consumer service, order number, supplier and product line) necessary to assess the quality of the services provided by KitchenAid suppliers with reference to specific services, products/product lines.

Until the questionnaire is sent or, with reference to the questionnaires concerning the delivery and installation service, Until the evaluation of the quality of the service provided by the suppliers or, in any case, until you object to the processing of the data.

i) When requested by you, we will inform you by email when a product on the Website is back in stock, when the price of a product drops or send you a comparison table between the products you have chosen.

The provision of personal data is optional for this purpose. If you do not provide your data, we will not be able to fulfill the request.

j) Allow you to participate in promotions, prize draws and competitions organized by KitchenAid or by third parties on behalf of KitchenAid.

Depending on the promotion or competition, the legal basis may be the performance of a contract of which the User is a party or of pre-contractual measures adopted at the request of the same - Art. 6 (1) (b) GDPR - or your freely given consent - Art. 6 (1)(a) GDPR.

Where consent is collected, the provision of personal data is necessary for this purpose.If you do not provide your data, it will not be possible for you to participate in the promotion.

For the duration of the promotion or the competition.

k) Recording and listening to the phone calls you made to the consumer call center, for internal training, documentation and quality control / assurance purposes of the service provided.

Depending on the country, the legal basis may be your freely given consent - Art. 6 (1)(a) GDPR or the legitimate interest of KitchenAid or third parties - Art. 6(1)(f) GDPR to improve our documentation, training, quality/assurance control and ensure proper management of complaints and claims.

Where consent is collected, the provision of personal data is optional for this purpose. If you do not provide your data, there will be no consequences of any kind for you. 

Up to the evaluation of the quality of the service. 

l) Show you the purchases made on the Website as a visitor (and the related purchase information) in your personal account (if created).

m) Offer you the purchase of warranty extensions (by phone and on the Website), if your product is no longer covered by warranty or is only covered by legal warranty.

Your data will not be stored if the warranty is not purchased.

n) Provide extended warranty service purchased by you, including the full technical checkup, related phone support services, verification of the coverage period of the purchased product, repair and replacement of the product.

The provision of personal data is necessary for this purpose. If you do not provide your personal data, we cannot provide you with warranty extension services.

For the duration of the warranty and beyond in accordance with the law.

o) Using tracking technologies, analyze the traffic on the Website, to produce aggregate and anonymous statistics for the purpose of optimizing the services provided through the Website. We may also carry out analytics across systems where we host your personal data in order to enrich, improve or gain further insight into such data and datasets. This purpose includes activities such as the development and improvement of our applications, products and/or services and their analysis to help us better understand our customers in order to offer the most relevant communications, services, and experiences to them. Also, we may combine these data with data collected by you. The personal data we use for this purpose include our communications with you (including email/sms opens, clicks, unsubscribes).

Your freely given consent to install the tracking technology (see Cookie Notice).

Providing personal data for this purpose is optional. If you do not provide your personal data, there will be no consequences of any kind for you. 

Until data is anonymized, which takes place following the collection of data or, in any case, until consent is withdrawn.

p) Through tracking technologies, to analyse your behavior on the Website, your preferences, interests, purchase history, browsing experiences and interactions with our advertisements (including those that are sent by email) in order to create targeting audiences and/or personalize marketing communications that are shown to you or that are shown to individuals with similar interests/characteristics to yours (including on third party sites, such as on Meta platforms or when using Google services), as well as to understand and improve the effectiveness of our marketing strategy. To do so, we may also use the data collected by Meta or Google, when you navigate their platforms to show you targeted advertising. Where we do this, such targeting and the display of the relevant marketing communications will be entirely managed by Meta or Google based on cookies that are used on such platforms. 

Also, we may also combine data collected through tracking technologies with personal data we collected (for example, when you opt-in to receive marketing communications, register, purchase or register a product on the Website, or when you log in or visit Facebook or navigate through Google services e.g., the email).

For example, we may use the pixel provided by Facebook to understand your potential shopping interests displayed on the Website. Or, we may use cookies to verify the products you have left in your shopping cart and send you marketing communications with those products.

Your freely given consent, as required to install the tracking technology (see Cookie Notice). Providing personal data for this purpose is optional. If you do not provide your personal data, there will be no consequences of any kind for you. 

Until you withdraw consent.

q) In the event that you have been redirected to the Website by clicking in an advertisement for KitchenAid products shown on a third party site (affiliate publishers), evaluate, using tracking technologies, if the source site belongs to one of the affiliate publishers of Awin AG or similar companies and if you have completed the purchase (known as affiliate marketing).

Your freely given consent, as required to install the tracking technology (see Cookie Notice).

The provision of personal data is optional for this purpose. If you do not provide your consent, there will be no consequences of any kind for you. If you have given your consent, you can revoke it at any time.

Until the completion of the affiliate marketing transaction or, in any case, until the withdrawal of consent.

r) Carry out activities necessary for the transfers of businesses and business branches, takeovers, mergers, demergers or other transformations and for the performance of such transactions.

The legitimate interest of KitchenAid, the Whirlpool Group or third parties - Art. 6(1)(f) GDPR to develop and manage our business.

Until the extraordinary transaction is completed.

s) Prevent fraud and establish liability for cybercrime.

The legitimate interest of KitchenAid or third parties - Art. 6 (1) (f) GDPR to prevent fraud against the company by consumers, users and/or third parties and to manage network and information security.

For the term of the limitation period.

t) Protect KitchenAid's rights, both in and out of court.

The legitimate interest of KitchenAid or third parties - Art. 6 (1) (f) GDPR to enforce civil claims or to defend against such and other claims.

u) Fulfill KitchenAid's legal obligations and respond to requests from competent authorities.

3. DATA PROCESSING PROCEDURES

Your personal data is processed with the support of Information Technology and/or paper means and it is protected by appropriate security measures suitable to ensure the secrecy and security of the personal data. More specifically, KitchenAid adopts the appropriate administrative, technical, personal and physical measures designed to protect personal data against any loss, theft as well as unauthorized use, disclosure or modifications of the personal data.

 

4. COMMUNICATION OF DATA

Your personal data will be processed by KitchenAid employees, who have been trained and authorized to process personal data in accordance with the provisions of the GDPR.

Your personal data may also be shared with the following recipients (please note that not all of the listed third parties will receive your data):

  1. companies of the Whirlpool Group located in the United Kingdom (UK), European Economic Area (EEA) and outside the UK or EEA, acting as autonomous controllers;
  2. service providers located in the UK or EEA and outside the UK or EEA, such as, IT service providers (e.g. e-mail and cloud providers) and systems management and IT maintenance professionals, distributors of our products, suppliers of logistics and delivery services for our products, suppliers of technical assistance services, repair and maintenance of our products, call center operators and customer service providers, agencies and providers of services of digital marketing and advertising of our products (for example, Meta Platforms Ireland Limited), reviews and ratings service providers, cookie providers, tracking technologies and web / email analytics services (for example, Google Analytics offered by Google LLC.). These entities work on our behalf as data processors or independent data controllers, as appropriate; 
  3. electronic payment service providers, in order to manage payments related to your orders. For the sake of clarity, KitchenAid does not process any banking / financial data (including credit card information) of the Users. In relation to this processing, the electronic payment service providers will process your personal data as independent data controllers, in compliance with the GDPR (and with any other applicable local legislation) and with the relevant privacy policies. KitchenAid is not responsible for any damages (including those deriving from the violation of the GDPR and any other applicable data protection legislation) deriving from the processing of the User's banking / financial data (including credit card data) by such third parties;
  4. Nayan NV, operator of the KitchenAid online shop and the seller of the items sold on this Website, whose office is located at Pittemsestraat 58D, 8850 Ardooie, Belgium. Nayan is a recipient of your data for the purposes of the contract concluded with you when purchasing an item from this website or extended warranty services; 
  5. independent authorities, law enforcement agencies and/or judicial and administrative authorities for their institutional purposes as prescribed by law;
  6. third parties involved in an extraordinary corporate transactions, such as a merger or the sale of a business unit, including those who provide them with advice in the context of the transaction;
  7. entities that provide specific legal, financial or tax consultancy services;
  8. For the purpose of analysis, the emails of our newsletters contain a "tracking pixel", of the company Salesforce.com Inc. which connects to the servers of Salesforce when the email is opened. In this way, it can be determined whether a newsletter email has been opened.

    Remarketing, Social Media and Affiliate Marketing recipients of data:

  9. Meta Platforms Ireland Limited ("Meta Ireland"), which provides KitchenAid with a service for the creation of targeted audiences as well as with a tracking technology (pixel) through which personalized advertisements or web forms through which users can subscribe to commercial communications from KitchenAid are displayed on the social network. Through the service known as Custom Audience, KitchenAid sends Meta Ireland your contact details in order to create an audience of consumers to be targeted on the social platform with marketing communications: for such processing activities, KitchenAid is the data controller while Meta Ireland is our data processor and a data processing agreement has been concluded. The pixel (called Facebook pixel) tracks your behaviors and interests shown on the Website, transmits them to Meta Ireland and, also by combining the information it already has about you, shows you interest-based advertising of KitchenAid products (known as Website Custom Audience), or web forms to subscribe to commercial communications from  KitchenAid (known as Lead Ads), to you or to users of Meta Ireland who have common or similar characteristics / interests to yours (known as Lookalike Audience). For the processing carried out jointly in order to show you the advertisements or web forms indicated above, we and Meta Ireland act as joint controllers and, to this end, we have entered into a joint controller agreement which sets out our responsibilities to comply with the obligations under the GDPR (available at the following link). According to this agreement, KitchenAid is responsible for providing you with the information referred to in Articles 13 and 14 GDPR, while Meta Ireland is responsible for responding to your requests to exercise the rights referred to in Articles 15-20 GDPR with reference to the personal data stored by Meta Ireland following the processing. In any case, you may address your requests for information or exercise your rights with reference to the data processing carried out as joint controllers with both joint controllers. KitchenAid and Meta Ireland act as independent data controllers in relation to the processing of your personal data that you provide via the web form through which you subscribe to commercial communications (Lead Ads service). Moreover, KitchenAid uses Meta Ads Manager service of Meta Ireland through which we send targeted marketing communications on Meta social media platforms, on the basis of selected criteria rendered available by Meta Ireland: for the sake of transparency, please note that we do not access to the identity nor other information of Meta’s users to which the marketing communications are shown. The contact details of Meta Ireland and its Data Protection Officer, as well as further information on how Meta Ireland processes your personal data (including the legal basis referred to and how to exercise your rights in relation to Meta Ireland), can be found at https://www.facebook.com/about/privacy.
  10. Google LLC. (or its subsidiaries), which provides KitchenAid, as part of the Google Ads services, tracking technologies through which personalized advertisements or web forms in which to subscribe to commercial communications from KitchenAid are displayed by Google LLC. within its services. These tracking technologies (remarketing pixel and Google Analytics integrated with Google Ads) track your behavior and interests on the Website, transmitting the relevant information to Google LLC. Google LLC., also through combination with information it already has on you, may show you ads for products of KitchenAid, personalized on the basis of your interests (known as Remarketing), or web forms through which you can subscribe to commercial communications from KitchenAid (known as Lead Form), to you or to users of Google LLC. who have characteristics and/or interests that are similar to yours. Affiliate publishers place advertisements from KitchenAid on their websites and, when you click on the advertisement, you are redirected to the website which, using the tracking technology provided by Awin AG, recognizes whether the originating website belongs to an affiliate publisher and tracks whether you make a purchase. For processing carried out jointly, KitchenAid and Awin AG act as joint data controllers and for this relationship we have entered into a joint-controller agreement that sets out our respective responsibilities with regard to compliance with our obligations under the GDPR (the essential content of which can be requested by sending an email to global_privacy@whirlpool.com). 5. DATA TRANSFER OUTSIDE OF THE UK AND EEA

We may transfer your personal data to a country outside the UK or EEA. Any transfer of your personal data to a country outside the UK or EEA (whether within or outside the Whirlpool Group) will be done in accordance with the GDPR when:

  1. the country to which the personal data is transferred has been the subject of an adequacy decision by the European Commission (or England Department of Media Culture and Sport, where applicable), pursuant to Article 45 GDPR; or
  2. when adequate safeguards have been provided by or to the Whirlpool Group company exporting your personal data, pursuant to Articles 46 - 48 GDPR, including, without limitation, when the importer has signed the standard contractual clauses made available by the European Commission or, where the UK GDPR applies, the international data transfer agreement or international data transfer addendum made available by the UK Information Commissioner's Office. In any case, the transfer based on one of the instruments indicated in Articles 46 - 48 GDPR will be accompanied by additional contractual, organizational and technical measures, if this is necessary to ensure that your personal data is guaranteed a level of protection substantially equivalent to that guaranteed in the UK or European Union.

The right to object to the processing of all or part of your personal data if the processing is based on the legitimate interest of KitchenAid (or a third party) and if, in light of your specific situation, you wish to object to the processing because you believe that it affects your fundamental rights and freedoms. In some cases, we may continue to process your data if we demonstrate compelling legitimate grounds which override your rights and freedoms, or if the processing is necessary to establish, exercise or defend our legal claims. However, if you object to the processing of your data for marketing purposes, we cannot for any reason continue to process your data for such purposes.
